Privacy Policy

1. Scope.

Company takes your privacy seriously. This policy explains how Company collects, uses, and protects Information submitted and collected generally on its website or through its mobile application (together, the Platform). This Privacy Policy is not a contract and does not create any contractual rights or obligations.

a. Information means information that determines the identity of an individual.


2. INFORMATION Collected.

a. Registration Data. When registering with our Platform, you will provide Information (such as company name, individual name, address, phone number, and email address).

b. Sensitive/Personal/Other Information. For our business purpose, Company may collect the following additional Information:

i. identifiers (such as contact information);

ii. sensitive/personal information (such as your name, driver’s license, social security number, user name and password);

iii. protected classification information like race, gender, ethnicity, etc.; 

iv. payment, billing, and shipping information; as well as information and documentation on any required licenses and certification if you are buying products and services through the Platform; and

v. transaction information, Internet/electronic activity information, geolocation information, Platform usage information, and inferences from the foregoing.

3. Uses.

Company uses the Information for business purposes, including without limitation:

a. Platform. To provide, maintain, personalize, customize, and develop the Platform;

b. Communication.  To communicate with you about your account in the Platform (including transactional activity within your account), and to notify you of things like Platform changes and updates.

c. Support. To provide technical support to you and debug our Platform.

d. Security. To detect security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.

e. Quality. To maintain the quality and safety of the Platform, and to enhance, improve and update the Platform.

f. Auditing. To audit activity in our Platform, including legal, regulatory and industry compliance.

g. Research and Development. To perform internal research and technological development and demonstration.

h. Aggregate Non-Identifiable Information. To create aggregated, non-identifiable information from the Information to improve our Platform and for other internal and external purposes.

i. Email Marketing. To send you marketing emails. You can always ‘update your preferences’ or ‘unsubscribe’ from those emails within the body of the email.

4. TRACKING, DISCLOSING and SHARING.

a. Cookies and Other Tracking Technologies. Modern web browsers are configured to accept browser cookies by default. You may choose to configure your browser to remove or reject cookies. If you elect to remove or reject cookies, the functionality of our Platform will be affected.  Our platform also uses Google Analytics to help us understand things like how you navigate through our Platform, and “tracer tags” to help us understand things like your location data (to help you, for example, easily find available inventory of sellers in your area), and what part of our Platform you are interacting with.

b. Service Providers. Company may share Information to certain service providers, as follows:

i. Credit card processors;

ii. Hosting providers; and

iii. Other contractors providing Platform on our behalf, with the appropriate protective contracts in place.

c. Retailers. Company may share your Information with retailers or others with whom you engage in a transaction.

d. Legal Requirements. Company may be required by law to disclose your Information, and we will try to take steps to limit any such disclosure.

e. Change of Ownership. If Company is acquired or otherwise sell our business, we will transfer all the Information to the successor entity. Company will try to notify you of any change in ownership or sale by either posting it on our site or by emailing you (at the email address in the system).

f. No Sales of Information. Company does not sell your Information to any third parties.

5. YOUR RIGHTS IF YOU ARE A “CONSUMER” UNDER THE LAWS OF THE STATE OF CALIFORNIA.

a. Do Not Track. While some internet browsers offer a “do not track” or “DNT” option that lets you tell websites that you do not want to have your online activities tracked, these features are not yet uniform. Therefore, we do not currently commit to responding to browsers’ DNT signals with respect to our websites.

b. If you are a “Consumer” and any Information that we collect falls under the definition of “personal information” as that term is defined under the California Consumer Privacy Act (CCPA), the following applies:

i. You can ask us what personal data we hold about you, the source of the information, the use of your personal information, and you can ask us to access it, to have a copy of it, and to erase it, under certain circumstances (a “personal information request”) that was collected about you during the 12 months before your personal information request.

ii. You can ask us if the information was disclosed to third parties, the categories of personal information disclosed to third parties and the categories of third parties to whom such information was disclosed.

iii. To exercise your rights regarding your personal information by email, mail, or phone, please use the contact information provided at the bottom of this policy. When you make a personal information request, we will need to collect information from you so that we can verify your identity, and we will respond to all legitimate requests within 45 days.

iv. Company will retain your personal information in accordance with our then current data retention policy, unless you otherwise request that it be deleted sooner, in accordance with this Privacy Policy.

v. You have the right not to be discriminated against because of exercising any of your rights under the CCPA.

6. Other Terms.

a. Application of this Policy. By registering on our Platform, you agree to comply with the terms of this Privacy Policy and that we may process your Information.

b. Industry Standard Security. While we use industry standard security measures to protect against the loss, misuse, and alteration of the Information under our control, there is no guaranty that it cannot be compromised.

c. No Under Age 13. Company does not intentionally gather Information about visitors who are under the age of 13.

e. Links to Third Party Sites. Our Platform may contain links to other sites and services, which are owned and controlled by others. These third-party sites and services have their own policies regarding privacy, and you should review those policies.

f. Revisions to this Policy. Company may change this policy at any time. Notice of any significant revision will be called out on the Platform for a period of time.
